these Terms of Use from time to time without notice to you. You acknowledge and
agree that it is your responsibility to review this site and these Terms of Use
from time to time and to familiarize yourself with any modifications. Your
continued use of this site after such modifications will constitute
acknowledgement of the modified Terms of Use and agreement to abide and be bound
by the modified Terms of Use. As used in these Terms of Use, references to our
"Affiliates" include our owners, subsidiaries, affiliated companies,
officers, directors, suppliers, partners, sponsors, and advertisers, and
includes (without limitation) all parties involved in creating, producing,
and/or delivering this site and/or its contents.
Terms and Conditions of Sale
Sale and Purchase of Goods
PURE Fashion Boutique ("Seller") hereby agrees to
sell, and You ("Buyer") hereby agree to purchase, goods of the
description and quantity described on the checkout window
("Checkout") and incorporated herein by this reference
("Goods") on the terms and conditions set forth in this Agreement.
Purchasing Price
Buyer agrees to pay the Purchase Price of the Goods as
posted on this website attached hereto.
Payment Terms
The total amount of the Purchase Price shall be payable in
full by Buyer immediately. Credit card fraud and theft of our merchandise will
be prosecuted to the fullest extent of the law.
Please note: Prices, specifications, and availability of
products are subject to change without notice. Any typographical, photographic,
or specification error in products or pricing is subject to correction.
Shipping/Delivery/Handling Time
Once items are in stock our normal order processing/handling
time is typically 3-5 business days. Your order will be shipped by FedEx International Priority Mail (3-5 business
days). to the shipping address that you provide. It is of extreme importance
that accurate address information is provided. For all international deliveries
a phone number is also required.
Unless otherwise agreed in writing, delivery shall be made
in accordance with Seller's shipping policy in effect on the date of shipment.
Delivery dates provided by Seller are estimates only. Seller will make
reasonable efforts to deliver in accordance with such dates. We are not held responsible
for unforeseen shipping delays or inclement weather deemed an as ACT OF GOD.
Once your items have been placed in the custody of the shipping agent) i.e.
FedEx. We are not responsible for shipping delays that occur after your items
have been placed in the care of the shipping agent. NO REFUNDS WILL BE
ISSUED FOR REFUSED OR ABANDONED SHIPMENTS.
Order Cancellations
Once your order has been placed, and payment has been
rendered to us, there are no order cancellations for any reason.
International Shipments
All International Shipments are subject to customs
clearance. Each Country/Region/Territory has its own applicable laws. All
additional fees, taxes, duty fees etc, are the responsibility of the buyer. We
are not liable for any additional fees that may be assessed for your items to
be cleared and released.
Return policy
At PURE Fashion Boutique our quality assurance level is
unprecedented. All of our items are thoroughly inspected for defects, etc prior
to your shipment. We ensure that every item that we release will be the
absolute best item available. We take great pride in our brand, and each and
every product that we offer. It is our duty to not only provide superb customer
service, but to also provide superb products for each and every order that is
placed. Due to the nature of our products, all sales are final. No Refunds
will be provided. Exchanges are offered on a case by case basis due to
defective items only; however if the Hair Care Instructions Listed and Provided by PURE Fashion Boutique are not followed we cannot be held liable. Please note Sales items are NOT ELIGIBLE for Exchanges all sales are FINAL.
Exchanges
In the event that an item has been deemed as exchangeable;
The item(s) must meet all the conditions notated below:
-We must be contacted within 30 days and informed of your
issue and intent of exchange. If items are sent to us without an initial
notification, the items will be refused and hereby returned to sender.
-The original item(s) in question to us, must be returned to
us within 30 days for an exchange to occur.
-The item must be in its original unaltered condition. (i.e.
not combed, brushed, dyed, cut, unbundled, cut, or processed in any shape form
or fashion. Upon receipt, if the items in question have been altered, they will
be returned to you and no exchange will be provided.
-Items can be exchanged for lesser or greater value. If the
selected item for exchange is of greater value than the original purchase
price, the buyer is responsible for an and all additional fees.
-For exchanges that are granted, not due to a manufacturer
defect. A 25% restocking fee will be assessed.
-There may be extended time delays for your replacement item
if it is out of stock, etc. An exchange may take up to 30 business days to be
shipped to the buyer. When you agree to the exchange, you acknowledge that you
are in agreement with all guidelines.
Limited Warranty
Seller supplies as its sole warranty the following:
Goods purchased from this website shall be free from defects
for a period of 30 days.
The warranty shall last for 30 days. In the unlikely event
that you receive a defective item, you must notify us within 30 days so that a
remedy can be initiated. We do not offer cash refunds, however we will
determine address the issue and provide an applicable resolution. At least 4 clear
photos depicting the defect, must be emailed within the 30 day period(beginning
upon the date of item delivery). The defective item(s) also must be returned at
the buyers expense within the 30 day period. The product will then be
evaluated. You will be contacted within 5 business days of the receipt of the
item to notify you of the next steps. We are not responsible for lost
shipments. We advise that you send your return items, via a
“trackable/traceable” method. We are not liable for detriment that occurs to
your extensions due to improper coloring services, “weft splitting”,
over-processing of the hair in question with dyes or chemical coloring agents
that result in damage to the original product. That damage includes shedding,
tangling, matting, etc that could occur due to bleaching/ color lifting, etc by
licensed hair professionals and or unlicensed, untrained individuals that are
engaging in the alteration of the original product.
For items which have been reviewed and deemed eligible for a
warranty replacement/exchange, the item(s) for exchange must be of equal or
lesser value. If the item is of greater value, the buyer is responsible for all
additional costs in excess of the initial purchase price. All shipping fees
incurred for returns will be the responsibility of the buyer. We reserve the
right to deny defective claims as we 2see fit.
If PURE Fashion Boutique, determines that the item(s) in
question are not deemed as worthy of a warranty replacement, the items in
question will be returned to the buyer without the option of exchange.
Force Majeure
Seller shall not be held responsible for any failure of
performance to make timely delivery of all or any part of the Goods in the
event such failure was due, in whole or in part, to federal, provincial or
municipal action, statute, ordinance or regulation, strike or other labor
trouble, fire or other damage to or destruction of, in whole or in part, the
Goods or the manufacturing facility for the Goods, the lack of or inability to
obtain raw materials, labor, fuel, electrical power, water or supplies, or any
other cause, act of God, contingency or circumstances not subject to the
reasonable control of Seller, which causes delays or hinders the manufacture or
delivery of Goods. Seller shall determine in good faith the extent to which it
can reasonably control a cause, contingency, or circumstance that affects the
performance of its obligations.
